APPENDIX 1.1.5. ABOUT THE PERSONAL DATA PROTECTION LAW

VISITOR INFORMATION NOTICE

  1. Purpose

Maltepe Imaging and Health Services Industry and Trade Inc. ("Radiologica" or "Company"), as the data controller, aims to process the personal data of visitors in accordance with the Law No. 6698 on the Protection of Personal Data ("KVK Law") and other relevant legislation.

Our Company, as the data controller mentioned above, hereby clearly informs you that your personal data obtained in the ways specified below, within the framework of the conditions set forth in the legislation, will be processed within the scope of commercial activities conducted directly with you or with the legal entity you represent, or within the scope of service relationships with you; for the purpose requiring their processing, and in a manner limited and proportional to this purpose, they will be protected, recorded, stored, preserved, reorganized, shared with authorized institutions entitled to request personal data by law, and transferred domestically or internationally to third parties under the conditions stipulated by the Law; assigned, classified, and processed in other manners specified by the Law.

This Information Notice has been adopted to ensure and develop the activities carried out by Radiologica in compliance with the principles set forth in the KVK Law.

2. Collection and Method of Visitor Personal Data

Our Company will process your personal data for the purposes specified in this Information Notice. Should there be any change in the purpose of processing your personal data, your separate consent will be obtained.

Data Category  
Identification Data Name and surname, Turkish ID number, tax identification number, etc.
Physical Space Security Data Camera recordings and security point records, etc.

 

The personal data collected and used by our Company concerning visitors especially include:

Your personal data are collected through identity documents (driver’s license, ID card, passport, etc.) you present to our Company (name-surname data recorded electronically/automatically or by non-automatic methods such as registration in a visitor book that is part of the data recording system) and through cameras placed in Company buildings (fully automatic).

Accordingly, the personal data we obtain and process are as follows:

Visitor visual data; Closed-circuit security camera footage

Other visitor data; Visitor entry/exit records

  1. Purposes and Legal Grounds for Processing Personal Data

Your personal data may be processed by our Company for the purposes stated below but not limited to these. Accordingly;

To fulfill the legal obligations of the data controller and under the provisions of the relevant Law, especially;

  • Ensuring workplace security
  • Fulfilling administrative obligations under the relevant legislation

Provided that it does not harm the fundamental rights and freedoms of the relevant person, and for the legitimate interests of the data controller;

  • Monitoring visitors

are the purposes of processing. Your personal data will be retained for a reasonable period specified in the relevant legislation or until the purpose of processing ceases, and in any case, for statutory limitation periods.

  1. Transfer of Personal Data to Third Parties

The procedures and principles regarding personal data transfers are regulated in Articles 8 and 9 of the KVK Law, and the personal data of the relevant person may be transferred to real or legal third parties.

Transfer of Personal Data to Third Parties Within the Country;

Provided that it does not harm the fundamental rights and freedoms of the relevant person, for the legitimate interests of the data controller, for the data controller to fulfill its legal obligations, and under the purposes set forth in the relevant Law;

  • To third-party service providers in case security services are outsourced,
  • To authorized public institutions and organizations, judicial authorities, and law enforcement agencies.

5.Ensuring the Security and Confidentiality of Personal Data

Our Company, in accordance with Article 12 of the KVK Law, takes all necessary technical and administrative measures to prevent unlawful processing and unlawful access to personal data and to ensure the protection of personal data. In the event that personal data processed unlawfully are obtained by others through illegal means, our Company will notify the relevant data owner and the Board as soon as possible.

6.Deletion, Destruction, and Anonymization of Personal Data

Pursuant to Article 7 of the KVK Law, personal data shall be deleted, destroyed, or anonymized by our Company ex officio or upon the request of the data subject when the reasons requiring their processing cease, despite being processed in accordance with the relevant legislation.

The procedures and principles regarding this matter will be carried out according to the KVK Law and secondary legislation based on this Law.

7.Your Rights Regarding the Protection of Personal Data

Pursuant to Article 11 of the KVK Law, you may apply to our Company and make requests concerning your personal data as follows:

  1. To learn whether your personal data are processed,
  2. To request information if your personal data are processed,
  3. To learn the purpose of processing your personal data and whether they are used accordingly,
  4. To learn the third parties within the country or abroad to whom your personal data are transferred,
  5. To request correction of your personal data if they are processed incompletely or incorrectly and to request notification of the transaction to third parties to whom the personal data are transferred,
  6. To request deletion, destruction, or anonymization of your personal data when the reasons requiring processing cease and to request notification of the transaction to third parties to whom the personal data are transferred,
  7. To object to the emergence of a result against the data subject by analyzing the processed data exclusively through automated systems,
  8. To demand compensation for the damage in case personal data are processed unlawfully.

Visitors may submit their applications and requests within the scope of the Law by filling out the “Application Form under the Personal Data Protection Law” available at “https://radiologica.com.tr/”;

  • Delivering it in person to Cevizli Mahallesi Fil Yokuşu Sokak No: 22/ Maltepe ISTANBUL address or sending it via Notary,
  • Sending it securely with an electronic signature or mobile signature to the address xxxxx@hs03.kep.tr via registered electronic mail (KEP), or to kvkk@radiologica.com.tr by using the electronic mail address previously notified to the data controller and registered in the system of the data controller.
  • Radiologica will conclude application requests free of charge within a maximum of 30 (thirty) days at the latest, depending on the nature of the request, in accordance with Article 13 of the Law. In case of rejection, the reason(s) for the rejection will be notified in writing or electronically with justification.
